Session I - Justice Through Integrity: Tackling Unethical Litigation Tactics with Strategic Advocacy – Charles Bennet

Litigation is inherently adversarial, but when unethical tactics arise—such as exploiting power imbalances, deploying delay strategies, or engaging in manipulative legal maneuvering—it undermines the justice system and erodes trust. In this CLE presentation, we will explore the dynamics of unethical litigation tactics through real-world examples, including cases where power imbalances were weaponized and procedural tools were abused. Using compelling case studies from my own practice, I’ll share practical strategies for identifying, addressing, and countering these tactics while maintaining ethical advocacy. Attendees will learn to balance zealous representation with fairness, effectively document unethical behavior, protect clients, and hold opposing counsel accountable—all while upholding the integrity of the legal profession. Session II - Recognizing and Responding to Unethical Tactics – Dan Schiavetta

Fortunately, unethical, unfair tactics are not as common as when I first started practicing. These involve getting into fights over petty matters (such as how long an adjournment to grant), objecting at deposition for nonsense reasons, and either being needlessly obstructive or making ridiculously broad, vague or improper discovery demands.

Dan Schiavetta, of counsel to Russo & Gould LLP in New York City, has been a litigator for 30 years and is admitted in all New York and New Jersey state and federal courts and the Second and Third Circuit Courts of Appeals. For 20 years he defended the Catholic Church in sexual abuse cases and other matters. He also has wide experience in insurance coverage litigation, nursing home defense, and appellate practice. He is a 1992 graduate of the University of California, Davis School of Law where he was a law review editor and moot court judge. In his previous career as a social worker he was the director of a crisis center and 24-hour hotline.
