Program Summary

Cause-Related marketing takes many forms when commercial companies invoke charitable purposes as part of their advertising. While such programs can be effective in generating goodwill and/or sales, they also can trigger regulation under laws governing charitable fundraising, including requirements for contracts, disclosures, and in some cases state registration. Learn the rules nationwide in all states governing the most popular forms of cause-related marketing, including charitable sales promotions (donation triggered by purchase of product), free-action programs (similar but without purchase), and donation-at-checkout. Special attention will be given to California’s new online charitable fundraising platform law which may have surprising implications for some of these programs.

This course is co-sponsored with myLawCLE.

Key topics to be discussed:

  • How to construct legally compliant programs
  • Do’s and Don’ts for disclosing donation amounts
  • State registration requirements and how to avoid them
  • IRS issues to consider from both the company and charity perspective
