This presentation will identify the different types of intellectual property (IP) assets that are typically relevant to trust and estate issues and why IP valuation is relevant to trust & estate professionals. It will identify high profile examples supporting the importance of IP valuation for trusts & estates. We will introduce various fundamental issues relevant to all IP valuation exercises and how they are typically addressed in a trust & estate context. The presentation will identify and explain the three traditional IP valuation approaches and we will provide examples of interesting issues we have faced when performing valuations of IP for trust & estate purposes.

Scott Weingust | Stout
Scott Weingust is the leader of Stout’s Intellectual Property Valuation practice. Scott has more than 26 years of experience providing consulting services to corporations, law firms, universities, and investment firms primarily in the areas of intellectual property (IP) valuation, damages, monetization, and management. His practice focuses on patents, trademarks, copyrights, trade secrets, the right of publicity (i.e., name, image, and likeness), software, domain names, and other intangible assets.
Scott has provided testimony as a damages and valuation expert in IP-related litigation including having offered opinions in Federal District Court. Scott has valued IP and other intangible assets for a variety of purposes including: transactions (licensing, purchase/sale, joint ventures, mergers and acquisitions), tax strategy and compliance (related-party transactions, trust & estate issues), corporate strategic decision-making, use of intellectual property to attract capital (debt and equity financing), financial reporting, regulatory compliance (Stark Law, Anti-Kickback Statute), and bankruptcy, among others. He has been directly involved in IP licensing negotiations and has developed many dynamic IP pricing/valuation models for corporate licensing activities and investment decisions. Scott is currently an adjunct professor at DePaul University’s College of Law where he teaches a course on IP valuation.
Matthew Vold | Stout
Matthew Vold is a Director in Stout’s Intellectual Property practice. He has over 19 years of experience providing consulting services to clients in the areas of intellectual property valuation and disputes, business valuation, complex commercial disputes, and transfer pricing. Matthew has valued patents, trademarks, copyrights, and other intangible assets for a variety of transactions, including mergers and acquisitions, licensing, and joint ventures, as well as for transfer pricing and estate tax issues.
He has also performed business and legal entity valuation for public and private companies for purposes of supporting various tax and financial reporting requirements. In addition, Matthew has provided dispute resolution services in matters related to patent, copyright, trademark, and trade dress infringement; trade secret misappropriation; breach of contract; transfer pricing; accounting malpractice; bankruptcy; and Section 337 intellectual property matters before the U.S. International Trade Commission.
