Program Summary

Session I - Expert Depositions: Strategic tactics and legal best practices - Brandon Schwartz

This session, “Expert Depositions: Strategic tactics and legal best practices,” will provide a comprehensive exploration of the critical role expert depositions play in federal litigation. Participants will learn how to determine when and why to depose an expert, weigh the benefits and potential risks, and navigate the Federal Rules governing expert depositions. The program will cover essential preparation strategies, including the review of key materials and the development of focused questions, as well as effective questioning techniques to challenge an expert's testimony. Special attention will be given to the complexities of deposing hybrid witnesses, who serve as both fact witnesses and experts. Additionally, the session will offer professional practice insights, highlighting key strategies and moral considerations to ensure successful depositions.

Key topics to be discussed:

  • Understanding the strategic importance of expert depositions
  • Navigating federal rules for expert depositions
  • Preparation essentials
  • Questioning techniques
  • Deposition of hybrid witnesses
  • Professional practice insights

Session II - Avoiding Ethical Violations When Preparing, Taking, And Defending Depositions - Veronica Finkelstein

Depositions can tempt even ethical lawyers to bend the rules because preparation is done in private and there is no judge present when depositions are taken and defended. Learn how to remain ethical while still getting the most out of the deposition process.

Key topics to be discussed:

  • How the rules of professional conduct condition deposition preparation and conduct
  • How to ethically prepare a witness while still defending your client's litigation interests
  • How to take and defend a deposition without increasing the litigation risk for your client
  • How to handle the unique considerations that arise in online depositions

This course is co-sponsored with myLawCLE.
