Program Summary

Session I - Metaverse 101 – Charles Macedo

Charley Macedo will provide a brief introduction as to what is “The Metaverse” in its various incarnations, to help guide the discussions in the full lecture. While everyone discusses “The Metaverse” in terms of “The” Metaverse, it comes in many different forms and visions. Industry leaders like Gemini, Facebook (now Meta), Microsoft and others have staked out their respective visions as to what The Metaverse is (and should be). In this preliminary stage, Charley will explain the following key topics.

Key topics to be discussed:

  • What is “a” metaverse, and traditional examples of where virtual space has been
  • Review the visions expressed for “their” Metaverse’s by Gemini, Facebook (now Meta), Microsoft and others
  • Offer key technical issues to consider when considering how Metaverse[s] are going to interact with our everyday existence

Session II – Intellectual Property Challenges in Metaverse – Charles Macedo
Charley Macedo will address the intellectual property law challenges associated with participating in the Metaverse (as well as not participating in the Metaverse). In this new virtual world, participants will be making, using, buying, and selling virtual versions of everything you might have in a real-world existence. This creates opportunities and challenges for participants and even non-participants.

Key topics to be discussed:

  • Learn how creators of virtual spaces and objects will need to consider traditional trademark, copyright, and intellectual property rights for the spaces they create and use in virtual space
  • Learn how intellectual property owners in the real-world will need to consider how to protect their valuable trademark, copyright, and other intellectual property rights in these new virtual spaces
  • Learn how new technologies and patents rights might be implicated in these new virtual spaces

Session III - Advertising in the Metaverse: How Brands Can Join in the Fun – Hannah E. Taylor
How to counsel brands and agencies on their foray into the Metaverse

Key topics to be discussed:

  • What are advertisers doing in the Metaverse?
  • What legal issues does this activity raise?
  • How can lawyers most effectively counsel clients looking to play in this new universe?

A physicist by training, uses his comprehensive patent experience to tackle the most important and complex developments affecting IP strategy today, including subject matter eligibility under 35 U.S.C. § 101, divided infringement under § 271, and navigating PTAB and PTO proceedings. He has been counseling on amicus briefs to the Supreme Court in the influential subject matter eligibility cases decided in the past few years, including Alice, Mayo, Myriad, and Bilski.

Mr. Macedo is considered an authority on IP issues and writes prolifically and lectures regularly as he tracks and analyzes in real time the most important developments affecting IP strategy and litigation. He is consistently at the forefront of complex and emerging patent issues in the financial services and transaction processing industries. Clients ranging from international banks, broker dealers and new business ventures call on Mr. Macedo to develop patent strategies, prepare patents, assert rights, and defend against infringement claims.
He holds bachelor’s and master’s degrees in physics from The Catholic University of America and a law degree from Columbia Law School, all with honors.

He was the sole law clerk to Hon. Daniel M. Friedman of the U.S. Court of Appeals for the Federal Circuit, 1989–1990. The recipient of the prestigious AIPLA Robert C. Watson Award, Mr. Macedo is included in Super Lawyers, IP Stars and Million Dollar Verdict. He also was a member of the Editorial Board for the American Intellectual Property Law Association Quarterly Journal and currently serves on the Editorial Board for Journal of Intellectual Property Law and Practice published by Oxford University Press.
