Session I – Most Common Pitfalls Every Litigation Attorney Needs to Avoid to Become a Successful Litigator – Dan Schiavetta, Jr.

This broad overview of the litigation process, from Complaint through Appeal, is organized around four concepts and how they apply to each stage. Examples will be given from the presenter’s experience (both good and bad) and efficient/effective practices contrasted with inefficient/ineffective.

  • Evidence: how to assemble it, how to refute it
  • Dealing with people: clients, vendors, witnesses, adversaries, judges

Session II – Avoiding Pitfalls with Clerks and Client – John Quinn

Mr. Quinn will examine the role of the judicial law clerk vis-a-vis the court and you, as the litigating attorney. He will look at ways to enhance your relationship with judicial law clerks and ways to engender distrust and dislike. He will examine the role that the judicial law clerks play in the civil justice system.

Session III – Ethics: Recent Trends and Recurrent Issues – John Quinn

Mr. Quinn spent the first two years of his forty-six-year career prosecuting cases for the Pennsylvania Disciplinary System. Since that time, he has maintained an active practice involving all types of lawyer issues, including representing respondent attorneys in disciplinary cases. Mr. Quinn will discuss hot issues involving allowing non-attorneys to own law firms; splitting fees with non-attorneys; and the continued furor over model Rule 8.4(g). On the recurrent trend side of things, Mr. Quinn will examine continued issues in conflict-of-interest cases. Finally, Mr. Quinn will explore the move to modify model Rule of Professional Conduct 7.2 dealing with solicitation.

Dan Schiavetta, of counsel to Russo & Gould LLP in New York City, has been a litigator for 30 years and is admitted in all New York and New Jersey state and federal courts and the Second and Third Circuit Courts of Appeals. For 20 years he defended the Catholic Church in sexual abuse cases and other matters. He also has wide experience in insurance coverage litigation, nursing home defense, and appellate practice. He is a 1992 graduate of the University of California, Davis School of Law where he was a law review editor and moot court judge. In his previous career as a social worker he was the director of a crisis center and 24-hour hotline.

Mr. Quinn served two years as an assistant disciplinary counsel with the Disciplinary Board of the Supreme Court of Pennsylvania/ He has been active in the Allegheny County Bar Association, the Western Pennsylvania Trial Lawyers Association, Pennsylvania Association for Justice. Mr. Quinn has been listed as a Pennsylvania Super Lawyer and can be found in The Best Lawyers in America. He has lectured extensively for various organizations on the areas of insurance law, trial practice and ethics. Mr. Quinn earned his B.A. degree from Duquesne University and J.D. from Duquesne University School of Law.
