Program Summary

Session I – Advising Clients How to Use ChatGPT in Their Business Without Stepping on Legal Landmines – Jeremy L. Kahn

Generative AI tools such as ChatGPT have the potential to transform industries ranging from healthcare to finance, and everything in between. But they also come with risks that could harm your clients’ business interests or expose your clients to liability. It is important for attorneys to educate themselves about this new technology to properly advise their clients on how to use it to their benefit while navigating around the legal landmines. This presentation will provide an overview of the benefits and risks of generative AI and the legal implications of generative AI across several areas of the law to enable you to confidently advise your clients about this transformative technology.

Key topics to be discussed:

  • Benefits of ChatGPT/generative AI
  • Risks of Using ChatGPT/generative AI
  • Legal considerations in the areas of privacy laws, intellectual property (trade secrets and copyright), employment, and torts

Session II - ChatGPT: A lawyer's friend or ethical time bomb? a look at professional responsibility in the age of AI - Devin R. Bates and Laura Bates

The emergence of ChatGPT comes with tremendous promise of increased automation and efficiency. But at what cost? In this CLE, we’ll explore the potential ethical time bomb of using ChatGPT and examine the responsibility of lawyers in the age of AI. Rather than focusing exclusively on ChatGPT or getting too prescriptive, we will focus more generally on generative AI and the ethical concerns facing lawyers when approaching this new technology. We will base this CLE presentation on the Model Rules of Professional Conduct, rather than any specific jurisdiction’s rules.

Key topics to be discussed:

  • How generative AI can be and is already being used in the practice of law
  • Ethical duties of lawyers using generative AI
  • Practical tips and suggestions for safely using ChatGPT today

This course is co-sponsored with myLawCLE.
