Program Summary

Session I – The Trust Accountant’s Handbook: A complete guide - Deborah J. Schaefer

It is a normal practice for law firms to accept retainers from clients to keep cash flowing into the business. These funds may be required to be deposited in a trust account. Most state bars have this requirement. Trust accounts are also used by lawyers to keep clients’ funds for other purposes, real estate deposits, liens, settlement funds, and the like. Lawyers are required by the state and federal bar to properly account for all of movement of the clients’ funds held in trust. These bank accounts are also referred to as IOLA, Interest on Lawyer Account. The Safekeeping Rule specifies exactly how the funds are to be accounted for. Every state will periodically do random audits to be sure the trust funds are being accounted for properly.

In this session, CPA and Legal Technology Trainer Deborah J. Schaefer explains the Safekeeping Rule and requirements, how to avoid misallocation of funds, plus how to use technology to keep your records accurate and up to date.

Key topics to be discussed:

  • Rules
  • Implementation of the rules
  • Three-way reconciliation
  • Solutions for trust accounting

Session II – Fiduciary Focus: Managing client money the right way – Tracy Kepler

This session will explore the financial responsibilities of lawyers under the ABA Model Rules of Professional Conduct, with a focus on Rules 1.5 (Fees), 1.15 (Safekeeping Property), and 1.16 (Declining or Terminating Representation). Attendees will gain a deeper understanding of the ethical considerations surrounding fee arrangements and responsible billing, what is a reasonable fee, handling client funds, and the proper procedures for managing and returning client property upon withdrawal or termination of representation. The session will provide practical insights and compliance tips to help lawyers meet their fiduciary duties and avoid common financial pitfalls.

Key topics to be discussed:

  • Understand Fee Agreements & Responsible Billing Practices: Learn the ethical requirements surrounding client fee agreements under Rule 1.5, including what constitutes reasonable fees and best practices for transparency in billing
  • Master Client Fund Management: Gain a comprehensive understanding of Rule 1.15, covering the proper handling, safeguarding, and accounting of client funds in trust accounts
