This program will also provide practical guidance and real-world examples to help attorneys achieve success in the courtroom.

  • Handling Expert Witnesses
  • Cross-Examining Adverse Witnesses
  • Opening and Closing Statements

Session II - From Pleadings to Post-Trial Motions: Mastering the art of preserving your case – Timothy Kowal

Trial success is more likely if your evidence and arguments get in more often than your opponent’s. As former Indianapolis Colts head coach Tony Dungy often noted, it is hard to win when you beat yourself with penalties. In this session, we will focus on the ways to preserve your best issues for trial, starting with pleadings, motions in limine, jury instructions, proffering evidence, dealing with verdicts and statements of decision, and being strategic with posttrial motions.

Key topics to be discussed:

  • Pretrial Preparation, Including Reviewing Your Pleadings, Jury Instructions, and Motions in Limine
  • Being Prepared to Get in Your Most Important Evidence, Including Expert Witnesses
  • Making a Record by Ensuring Sidebars and Objections to Jury Instructions are Done in the Presence of the Court Reporter
  • Posttrial Strategies, Including Making Rule 50(a) Motions Before Submitting to the Jury, Objecting to the Verdict, and Making Posttrial Motions

This course is co-sponsored with myLawCLE.
