Program Summary

 

The Trust You Drafted Five Years Ago May Not Survive This Client

Blended families, aging clients, and mid-life changes in circumstance are no longer the exception — they’re the rule. A trust drafted for one static household rarely survives remarriage, incapacity, or a vulnerable beneficiary.

Skip long-term care and Medicaid planning up front, and a client’s assets fund the nursing home instead of the family. Draft a rigid, single-purpose trust, and it can’t adapt when circumstances change — you’re back at the drafting table. Leave beneficiary protections generic, and a spendthrift clause with no teeth exposes assets to creditors and poor decisions.

You’ll leave with a framework for choosing the right trust structure, plus drafting language for spendthrift and discretionary provisions, trustee powers, and amendment mechanisms. A pitfall checklist flags the administration disputes boilerplate creates — judgment a template can’t replicate. You’ll walk through wills, powers of attorney, and probate avoidance in plain language you can hand straight to clients.
