The world of Ridesharing (Transportation Network Companies, “TNC”) has changed the way people get from point A to point B. The growth and adaptation of this technology and service has led to the business model of the gig economy. This session seeks to explain the uniqueness of the claim asserted in the ridesharing context and how best to pursue them.

Key topics to be discussed:

  • Liability structures in rideshare and delivery models
  • Layered insurance structures
  • Multi-defendant claims
  • Establishing negligence and causation in multi-defendant cases
  • Advanced discovery techniques
  • Damage valuation in complex rideshare and delivery cases

Session II - Emerging Trends and Legal Theories in E-Bike and E-Scooter Accident Litigation - James G. Perry

The use of micro-vehicles, including e-bikes and e-scooters, during many aspects of everyday life has exploded in cities across the country. This reality raises serious and complex legal issues, particularly when delivery drivers utilize this mode of transportation to complete their delivery obligations. From manufacturers and distributors to employers and government agencies, liability from a seemingly isolated vehicle collision involving an e-bike or e scooter can rope in a broad range of parties under various theories of liability. This session is designed to briefly explore the challenges related to micro vehicle liability, and touches on the history and evolution of e-bikes and e scooters, relevant laws and regulations, investigation of liability, potential parties to an action, theories of liability that may arise, defenses that may be applicable, and insurance issues that must be appreciated.

Key topics to be discussed:

  • Laws and Regulations related to e-bikes and e-scooters
  • Parties and theories of liability related to vehicle collisions involving e bikes or e-scooters
  • Insight into the investigation of a vehicle collision involving an e-bike or e-scooter
  • Defense and insurance related issues to be mindful of
