Session II - Ethical and Practical Pitfalls When Using Generative AI - Steve Delchin and Ken Moore

The rapid rise of generative AI raises significant ethical challenges for lawyers, including confidentiality concerns and the problem of AI hallucination. This engaging session will explore the ethical pitfalls of using AI in the practice of law and offer strategies and best practices to navigate the ethical challenges and manage risk.

Key topics to be discussed:

  • Ethical rules that apply to the use (and non-use) of AI in the practice of law
  • Key ethics opinions addressing lawyers’ use of generative AI tools
  • The problem of bias in the use of AI and the ethical concerns raised under ABA Model Rule 8.4
  • How lawyers should manage risk when using generative AI, including ethical supervision under ABA Model Rules 5.1 and 5.3

George Gazdick | Squire Patton Boggs

George Gazdick has served as the Global Chief Information officer for Squire Patton Boggs since joining the firm in 2003. With over 35 years of legal technology leadership experience, he advises the firm’s leadership and legal teams on leveraging both traditional and evolving technology in delivery of both internal business operations and client facing legal services. He is a member of the firm’s Administrative Management Group, as well as the firm’s data privacy task force and innovation committee. Mr. Gazdick has represented the firm’s and legal community’s interests as a CIO advisory board member for prominent legal technology companies and is an active member of ILTA’s G100 peer group.

 

Alex Goth | Squire Patton Boggs

Alex has 30 years of experience in the litigation technology field – 13 years as a vendor and 17 within a law firm. His background includes the management and development of a wide array of legal technology services as well as consulting on several high-profile cases for various federal/state agencies and corporations. This diverse background with both strategic development and tactical level implementation has allowed Alex to be actively involved with case teams and clients in all facets of technology related to data identification/preservation, collection, discovery, review, deposition, and trial preparation/presentation. Alex is the Director of Litigation Support & E-Discovery Services at Squire Patton Boggs and is a member of the firm’s Global Practice Support Group as well as the eDiscovery and Data Management Team.

 

Steve Delchin | Squire Patton Boggs

Steve Delchin is an experienced lawyer in the Cleveland office of Squire Patton Boggs. He has been with the firm for more than 27 years and also served a clerkship with the Sixth Circuit Court of Appeals. Steve has been practicing in the field of professional ethics for most of his career, and has become well known for counseling clients on sophisticated ethical issues. For the last seven years, Steve has written and lectured extensively on the use of artificial intelligence in the practice of law. He served as a member of the American Bar Association AI Ethics Group, which was formed to address ethical issues raised in the use of artificial intelligence in the practice of law.

 

Ken Moore | Squire Patton Boggs

Kenneth C. Moore is Chair of the Squire Patton Boggs Ethics Committee. For more than 50 years Ken has practiced in the fields of environmental law and commercial litigation, starting with the conclusion of his Fourth Circuit clerkship. For more than 20 years, he has spent a substantial proportion of his time in the field of professional ethics, advising clients – including other law firms − on legal ethics and governance issues and counseling firm lawyers around the globe. Among other recognitions, Ken has been named in Who’s Who in America and The Best Lawyers in America (over 30 years). Ken is a Trustee Emeritus and past chair of the Hiram College Board of Trustees and the past Chair and a Trustee Emeritus of the Board of Trustees of Laurel School.
