Program Summary

The insurance industry advertises fast and fair claim handling. In many cases, that is exactly what the insured and third-party claimant receive. Comparing what is normal and fair practice by a carrier vs. What is unfair claim and industry practice is essential to determining appropriate legal action.

This program will cover the five types of mishandling that can be pursued as bad faith actions. It also will cover mishandling of placing insurance that can lead to allegations of professional liability.

Key topics to be discussed:

  • Carrier misinterpretation of insurance contract language with the intent or result of denying or limiting claim payment
  • Carrier devaluation of monetary demands of claimants
  • Categorizing damage as an excluded peril to avoid paying a claim
  • Agency and direct writers’ failure to procure coverage requested by insured

This course is co-sponsored with myLawCLE.
