The Crypto Is Out There. Standard Discovery Won’t Find It
Digital assets no longer sit entirely off the record. Form 1099-DA and Revenue Procedure 2024-28 are bringing IRS reporting to cryptocurrency. New York’s 22 NYCRR § 202.16 and California Family Code § 1101 widen what a spouse must disclose. How much these changes will surface in discovery is still unfolding, and the gaps are real.
Ask only for bank accounts, and private wallets go uncaptured. Demand point-in-time balances, and valuation-date disputes stay open. Delay the preservation letter, and evidence on devices can disappear. Move to self-custody, and your exchange subpoena stops reaching the assets. Skip the foundation, and your blockchain forensic expert’s tracing gets harder to defend under Daubert.
You walk out with a working framework: preservation letters, tailored interrogatory categories, document demand checklists designed to survive a motion to compel, and targeted exchange subpoenas. You also get the judgment calls no template or AI tool makes for you: when to bring in a forensic expert, and when to seek contempt or adverse-inference relief.

SESSION 1 – Drafting Interrogatories and Document Demands That Capture Digital Assets in Divorce | 12:00pm – 1:00pm
This session teaches family law practitioners how to draft interrogatories and document demands that identify, preserve, and value cryptocurrency, NFTs, DeFi activity, and other digital assets in divorce litigation. Attendees will learn how recent IRS reporting mandates (Form 1099-DA, Revenue Procedure 2024-28) and state disclosure reforms (New York 22 NYCRR § 202.16, California Family Code § 1101) expand the paper trail available in discovery, and solutions to minimize exposure from the gaps that remain. Attorneys will leave with a working framework for preservation letters, tailored interrogatory categories, and document demand checklists designed to survive a motion to compel.
BREAK | 1:00pm – 1:10pm
SESSION 2 – Subpoenaing Cryptocurrency Exchanges and Compelling Disclosure in Divorce Litigation | 1:10pm – 2:10pm
This session teaches divorce attorneys how to subpoena centralized cryptocurrency exchanges and compel disclosure of self-custody wallets through court orders, blockchain forensics, and sanctions. Attorneys will learn the mechanics of serving exchange subpoenas across state lines, bridging the coldwallet gap with forensic tracing experts, and using contempt and adverse-inference motions when a spouse refuses to identify self-custody wallets. By the end of this session, attendees will be able to draft targeted exchange subpoenas, evaluate blockchain forensic expert qualifications under Daubert, and anticipate how the January 1, 2026 cost-basis reporting phase may impact the discovery landscape.
