Program Summary

Session I - EEOC’s New Enforcement Guidance on Harassment in the Workplace - Iryll Robbins-Umel, Tiffany Alvoid-Overton

On April 29, 2024, twenty-five years after the Equal Employment Opportunity Commission (EEOC) last released guidance on workplace harassment, the EEOC published an update. The new guidance provides best practices for preventing and remedying harassment, clarifies recent developments in the law, and addresses issues raised by the modern workplace. Federal discrimination laws protect employees from harassment based on race, color, national origin, religion, sex (including pregnancy, childbirth or related medical conditions, sexual orientation, and gender identity), disability, age (40 or older), or genetic information. Employment attorneys Iryll Robbins-Umel and Tiffany Alvoid-Overton will highlight major updates in the EEOC’s recent guidance on how to evaluate whether harassment violates federal EEO law. They will also provide practice tips for attorneys working on preventing and/or remedying harassment.

Key topics to be discussed:

  • Workplace protections for pregnancy, childbirth, or related medical conditions
  • Application of Bostock v. Clayton County to the harassment context
  • Preventing, addressing, and remedying harassment

Session II - Ethics for Attorneys Representing Women Facing Workplace Discrimination – Cynthia R. Mullins

Ethics constitute the foundation of the legal profession and help guide attorneys in making responsible decisions. Women in the workplace face myriad forms of discrimination at all stages of the career journey. Attorneys, the major advocates of justice and key defenders of the legal system's values, represent women workers and confront ethical dilemmas professionally and personally. This session will cover core concepts of the code of ethics and a decision-making framework to support attorneys representing women challenged by workplace discrimination.

Key topics to be discussed:

  • Model codes of ethics and professional responsibility
  • Forms of workplace discrimination women confront
  • Ethical dilemmas
  • Guide, framework, and considerations for navigating complex situations
