Program Summary

This CLE program offers attorneys an in-depth examination of insurance coverage issues arising under the Trafficking Victims Protection Reauthorization Act (TVPRA), a statute that has become a powerful tool for civil litigation, particularly targeting entities in the hospitality sector. The course begins with a deep dive into the TVPRA and its civil cause of action, followed by an analysis of recent case law trends shaping this evolving area. Attendees will gain insights into the types of insurance policies that may respond to TVPRArelated claims—including Commercial General Liability (CGL), Errors & Omissions (E&O), and Employment Practices Liability (EPL) policies—and the common coverage defenses insurers raise, such as exclusions for expected or intended injury, abuse and molestation, and assault and battery. The presentation concludes with a summary of key judicial decisions delineating the scope of coverage for TVPRA claims, equipping practitioners with a nuanced understanding of the intersection between human trafficking litigation and insurance law.

Key topics to be discussed:

  • Provide a summary of the Trafficking Victims Protection Reauthorization Act (the “TVPRA”), including an examination of the statute’s civil cause of action, which has led to a surge of litigation against hospitality-industry businesses
  • Review of recent trends in TVPRA case law
  • Analyze types of insurance that can cover TVPRA civil claims, including Commercial General Liability (“CGL”), Errors & Omissions (“E&O”), and Employment Practices Liability (“EPL”) insurance policies
  • Examine insurers’ coverage defenses, including several key policy exclusions, such as expected or intended injury, abuse and molestation, and assault and battery exclusions
  • Summarize key case law articulating the contours of insurance coverage for TVPRA claims and suits
