Fabricated authority now cuts both ways — the question is who catches it first

Twice named Miami’s Product Liability Lawyer of the Year by Best Lawyers in America, Frank is also a leading voice on AI adoption, helping clients navigate legal and regulatory challenges. A prolific author and mentor known as the “Miami Mentor,” he has written 20 books and over 500 articles guiding the next generation of lawyers.
Frank earned his J.D., magna cum laude, from the University of Miami School of Law in 1997 and his B.A., summa cum laude, from Florida International University in 1993. He has been a member of The Florida Bar since 1997 and is admitted to practice before the U.S. District Courts for the Middle and Southern Districts of Florida. SESSION 1 – A Repeatable System for Verifying AI-Generated Citations and Holdings | 2:30pm – 3:30pm
This session equips attorneys with a structured, six-step verification protocol for AI-generated legal research, covering citation existence, holding accuracy, quotation fidelity, and subsequent history. Attendees will learn how leading AI tools—including legal-specific platforms—fail, what the current sanctions landscape requires of them, and how to build a defensible, documented workflow before any AI-assisted brief leaves the office. Attorneys completing this session will be able to identify the specific failure modes of generative AI in legal research, apply a repeatable pre-filing checklist, and select the right verification tools for their practice.

SESSION 2 – Catching AI Hallucinations in an Opponent’s Brief and Litigating What Follows | 3:40pm – 4:40pm
This session equips litigators to identify fabricated or distorted AI-generated authority in opposing briefs, select the correct sanctions vehicle, and execute the procedural steps that follow discovery of a hallucination. Attorneys will learn the red flags that distinguish genuine AI confabulation from ordinary citation error, the Rule 11, § 1927, and inherent-power frameworks courts have applied, and how local AI-disclosure rules create compounding liability. Attendees leave with a replicable litigation playbook — from the first suspicious citation through a sanctions motion or bar referral.
