One FCC ruling turned every AI voice call into a class action trigger — for both sides
The FCC’s February 2024 Declaratory Ruling created an independent liability trigger for AI-generated voice calls. A first-wave case docket is already forming, and an emerging platform liability theory now targets technology providers. TCPA litigation no longer stops at the caller.
Structure a class definition well and it captures an entire vendor ecosystem. Deploy statutory damages math and settlement leverage multiplies. Miss the critical steps at the outset of litigation and the defense loses its best liability and class certification challenges. Consent attacks and vicarious liability chains decide who pays.
This program works both sides of the case. Plaintiff-side attorneys leave with the class action architecture, damages framework, and consent attack strategies to pursue AI voice callers. Defense counsel leave with a practical playbook — what to do, and what to avoid, in the TCPAWorld — plus current SMS trends.
