Program Summary

A money judgment is only a hunting license until the money actually moves

Many litigants win a civil judgment for monetary damages and then discover that no one writes them a check. What follows is a cat-and-mouse game. The debtor rearranges assets to avoid collection, while the judgment creditor’s attorney works to penetrate asset protection devices and reverse the debtor’s conveyances.

The moves cut both ways. Rearrange assets carelessly, and a fraudulent transfer claim can unwind the plan. Chase the wrong asset, and the creditor client waits while recovery stalls. Reach for offshore structures, and bankruptcy can defeat the protection entirely. Each side wins only by knowing what actually works.

This course teaches aspiring creditor attorneys and would-be asset protection attorneys what works and does not work in real-world judgment collection. Two very experienced presenters cover advanced collection techniques that compel payment. They teach domestic and offshore asset protection tools that drive substantially discounted judgment settlements. Attendees leave with practical advice on reversing and defending fraudulent transfer claims, plus the practical effects of bankruptcy on both sides.

Key topics to be discussed:

  • Head-to-Head Debate
A skilled creditors’ attorney and an experienced asset protection attorney argue both sides.
  • Advanced Collection Techniques
Collection methods that compel payment and get creditor clients paid quickly.
  • Asset Protection Tools
Domestic and offshore devices that drive substantially discounted judgment settlements.
  • Fraudulent Transfer Claims
Practical advice on reversing debtor conveyances and defending transfer challenges.
  • Bankruptcy Cross-Effects
How bankruptcy defeats offshore asset protection and reshapes both sides.
  • Real-World Outcomes
What works and what does not in actual judgment collection.

This course is co-sponsored with myLawCLE.
