Program Summary

The duty of competence no longer stops at the law — it reaches the generative AI tools attorneys feed client confidences into, the digital trail they leave online, and the manipulated evidence opposing counsel offers as authentic. ABA Formal Opinion 512 and expanding state guidance have redrawn competence, confidentiality, and candor around technology most lawyers deployed before any rule told them how, even as courts confront deepfake authentication without settled doctrine and discipline boards treat incivility as sanctionable conduct rather than courtroom color. Any attorney drafting with AI, posting about active matters, or pressing hard in a contentious deposition is already exposed — often on assumptions the rules have outpaced. This program maps Opinion 512 to concrete safeguards, separates zealous advocacy from sanctionable abuse under the Model Rules, and supplies authentication and civility strategies drawn from cases where the breakdown drew discipline. Attendees leave able to integrate AI, contest fabricated evidence, and advocate forcefully without risking a license.
