Program Summary

The district's first fourteen days build the record that decides the lawsuit

Students are using AI tools to generate nude images of classmates, and most districts are unprepared. The TAKE IT DOWN Act and rapidly shifting state legislation have changed what intake requires, while federal Title IX enforcement remains uncertain. The Lancaster Country Day School federal complaint now shows exactly how these incidents become litigation.

The exposure compounds fast. Miss a mandatory child-abuse report and the district creates its own liability. Retain the images as evidence and the district may violate federal CSAM law. Respond slowly and victim families file Title IX, state negligence, and Section 1983 claims under Davis v. Monroe's deliberateindifference standard.

Attendees leave with a jurisdiction-specific checklist for the first two weeks, a 14-day incident-response playbook, and a practical framework for evaluating exposure and positioning the district's response record as its primary defense. Sovereign immunity, superseding cause, Monell doctrine, and contribution claims against AI platform operators complete the defense toolkit.

Key topics to be discussed:

  • The Mandatory-Reporting Trap
How child-abuse reporting and CSAM-handling duties bind district counsel in the first 48 hours after an incident surfaces.
  • Title IX First Response
What Title IX and the TAKE IT DOWN Act require of a district in the first 24 hours, and the response timeline counsel must enforce.
  • The 14-Day Playbook
How to preserve evidence without unlawfully retaining CSAM while managing family notification and defensible discipline.
  • The Lancaster Case Template
How the Lancaster Country Day School federal complaint shows plaintiffs building deepfake-harassment cases against districts.
  • Davis v. Monroe Applied
How actual knowledge, the appropriate-person requirement, and deliberate indifference decide Title IX deepfake claims.
  • The Defense Toolkit
When sovereign immunity, superseding cause, Monell doctrine, and contribution claims against AI platform operators limit district exposure.

Agenda

SESSION 1 – The First Two Weeks: Advising a District Through a Student AI Nude-Image Incident | 1:00pm – 2:00pm

When a student uses AI to generate nude images of classmates, the district’s first fourteen days decide whether the incident is contained or becomes a federal lawsuit. This session gives district counsel a working playbook for that window: navigating mandatory child-abuse reporting, recognizing what Title IX and the TAKE IT DOWN Act require in the first 24 hours, preserving evidence without unlawfully retaining CSAM, and managing family notification and discipline. Drawing on real incident failures, including Lancaster Country Day School, we show where districts create their own liability, and how counsel prevents it.

BREAK | 2:00pm – 2:10pm

SESSION 2 – Defending Districts Against Deepfake-Harassment Claims by Victim Families | 2:10pm – 3:10pm

When victim families sue, the district’s exposure turns on the record built in the first days of the incident. This session walks defense counsel through the Title IX deliberate-indifference, state negligence, and Section 1983 claims now being filed over student-generated deepfakes, using the Lancaster Country Day School federal complaint as a live template. We examine how Davis v. Monroe applies to AI imagery, the sovereign immunity, superseding-cause, and Monell defenses available to public districts, and how to position the district’s response record as its primary defense.
