Many businesses are currently assessing, implementing, and integrating Artificial Intelligence (AI) into day-to-day operations in an effort to streamline various business processes with the goal of enhancing operational efficiencies and reducing costs. This session will focus on provisions in technology contracts that are targeted at Artificial Intelligence (AI) issues and risks. With an ever-increasing number of software applications and services now containing some form of AI functionality, technology contracts must address this new world, and both customers of AI and providers of AI will have differing perspectives on how AI functionality and its inherent issues and risks should be handled under these contracts.

As Artificial Intelligence (AI) tools become increasingly widespread it creates some unique issues in existing US patent practice. This session will discuss AI inventorship and the requirement for human contributions, AI issues with patent eligibility (i.e., 35 USC 101 issues), AI use creating disclosure problems for enablement, and disclosure and ethical practice risks with AI tools.

Chris has extensive experience and expertise in drafting, negotiating and advising on contracts, transactions and arrangements required by clients in a wide variety of sophisticated technology and market sectors. Having practiced law for more than 25 years, Chris has extensive experience working on intellectual property and technology transactions, including his time spent practicing in Silicon Valley. He helps his clients address the technology and licensing issues and their deals demand, ranging from the routine to the highly complex. Chris understands his clients’ needs and helps them develop sound legal solutions to their business requirements based on firsthand experience and success. He has represented and negotiated with some of the biggest and best-known technology companies in the world. Chris advises his clients on the protection, commercialization, licensing and transfer of intellectual property and technology. His practice includes the licensing and transfer of patents, copyrights, trademarks and trade secrets as well as the licensing of software and other technologies, and the procurement and distribution of SaaS, IaaS, PaaS and other cloud-based services. His expertise includes a wide variety of technologies such as flexible angular displacement sensors, touch screen devices, semiconductor devices, aircraft systems, routers and other networking hardware, software, network security, firearms and firearm accessories, environmental monitoring and cleanup, automotive systems, financial and banking systems, and medical devices. Chris frequently prepares opinions concerning patentability, non-infringement, invalidity, and freedom to operate, and has served as an expert witness in patent litigation. He has represented numerous clients in patent litigation matters in various U.S. District Courts, Appellate Courts, and before the Patent Trial and Appeal Board, including agribusinesses, online retailers, a 5G wireless networking company, a railroad inspection company, luxury automobile companies, medical equipment companies, and several others. Chris has also worked as a patent examiner at the U.S. Patent & Trademark Office, examining patent applications relating to electric motors and electric power generation in green technologies such as wind, wave, and solar power generation, among others.
