Program Summary

Taxpayers who own valuable intellectual property (IP) assets, such as copyrights, trademarks, service marks, patents, or other IP rights, have unique estate planning needs and challenges. Ensuring the ownership and/or control of these assets and their associated income streams passes securely and efficiently to or for the benefit of the owner’s family or other desired beneficiaries requires special consideration. This presentation will identify the different types of IP assets that trust & estate professionals may encounter, address tax impacts and transfer mechanisms associated with IP, propose ways to structure ownership and control of IP for estate and business planning, and explore unique challenges and strategies to avoid dispute and/or dissipation of value. Presenters will discuss real life examples of planning successes and failures involving IP assets and applications of the lessons learned.

Brendan Bybee, a native of Las Vegas with deep roots in Nevada, is a Partner with Stone Bybee & Associates, an estate and business planning law group serving clients in Nevada and throughout the United States. Brendan’s practice has been primarily focused on the area of trusts and estates since he was first licensed in 2011.

Brendan graduated with honors from the J. Reuben Clark Law School at Brigham Young University where he also served on the editorial board of the BYU Journal of Public Law. While earning his law degree, Brendan also completed requirements to graduate with his Master of Public Administration from the Marriott School of Management.

Brendan enjoys assisting clients in creating and implementing plans that help them control and protect their property during their lifetime, prepare for disability or death, and transfer their property to loved ones without unnecessary litigation or taxation. Brendan helps business owners organize their interests for asset protection and business succession through the strategic use of trusts and corporate entities. He also helps families employ strategies that fulfill their charitable intentions, promote family harmony, and provide for minors and children with special needs in the event of tragedy.

When not at work, Brendan likes to spend time with his wife and their four kids trying new recipes in the kitchen, tending the yard, or playing a few games.
