Many winnable trials are lost because evidence is excluded, or is admitted for the wrong purpose, or is weak when it could be strong, or maybe was never pursued or adduced in the first place. This presentation talks about the meticulous process of assembling a successful case. Dan discusses some of his own trial triumphs and disasters and the many mistakes and omissions it is possible to make, particularly in the era of electronically stored information (ESI) when so many new types of evidence are available.
