Program Summary

Rule 1.6(c) Makes Client Data Security an Ethical Duty

Client confidentiality no longer ends at the file cabinet. Rule 1.6(c) requires reasonable efforts to prevent unauthorized access to client information. ABA Opinion 512 extends that duty to AI tools. For solo and small firm attorneys, data security is now a defined ethical obligation.

The exposure follows a plain pattern. Store client data without safeguards, and Rule 1.6(c) is in play. Suffer a breach without a response plan, and notification requirements take over. Adopt AI tools without an ethics review, and Opinion 512 governs the fallout.

This program converts those duties into a working plan. Attendees leave with a clear reading of Rule 1.6(c), a breach response and notification roadmap, an AI ethics framework built on ABA Opinion 512, and a 30-day security implementation plan sized for solo and small firm practice.

Key topics to be discussed:

  • Rule 1.6(c) Obligations
Meet the cybersecurity obligations Rule 1.6(c) imposes on attorneys who hold client data.
  • Breach Response
Build a data breach response process before an incident forces one.
  • Notification Requirements
Determine when a breach triggers notification requirements and who must be told.
  • AI Ethics
Evaluate AI use in client work against the attorney's ethical duties.
  • ABA Opinion 512
Apply ABA Opinion 512 when deciding whether and how AI tools enter your practice.
  • 30-Day Security Plan
Implement a 30-day security plan sized for solo and small firm attorneys.

This course is co-sponsored with myLawCLE.
