This presentation will use case studies and real-world examples to illustrate and discuss best practices for mitigating the legal risks inherent in hiring, disciplining, and terminating employees. With respect to recruiting and hiring, in addition to discussing recent legal developments to be mindful of, we will also discuss best practices for ensuring every step of the hiring process is conducted in a compliant manner — from developing job descriptions to interviewing candidates to onboarding. The second part of this program will cover employee discipline, performance issues, and misconduct, with an emphasis on how to develop and implement policies and procedures that foster a positive workplace culture. Finally, the last part of this program will focus on legal considerations and best practices for terminating employees, including risks associated with termination and techniques for handling post-termination issues.
