Navigating an employee's or their family member's military leave can be complex, involving several intersecting laws. The Uniformed Services Employment and Reemployment Rights Act (USERRA) stands as a cornerstone, offering broad coverage and protections for service members. It ensures rights and benefits while they're away, including health insurance continuation akin to COBRA benefits, and safeguards against discharge upon reemployment. Additionally, USERRA addresses denial of reemployment, even if an employer's circumstances have changed. Resolving disputes often requires navigating the intersections of USERRA, FMLA, and VEVRRA, ensuring comprehensive protection for military service members and their families.
