Program Summary

This webinar provides a vantage point from a lawyer and an expert witness physician on a key area of many cases - radiology. This presentation begins with the current landscape of FRE 702 and 106, as well as nuances associated with certain states. From there, we delve into bias - both expert bias, from a jury and a cross examination standpoint, and bias in radiology interpretation. Finally, a discussion of the various radiology tests, nuances of everything from a fMRI to a CT scan, and areas to consider when having an expert interpret a film are covered.

Rachel V. Rose, JD, MBA successfully advises and represents clients on healthcare, cybersecurity, securities, and qui tam compliance, transactional, litigation, and government enforcement matters. Ms. Rose is also an Affiliated Member with the Baylor College of Medicine’s Center for Medical Ethics and Health Policy, where she teaches bioethics. She has served as a consultative expert and testifying expert, as well as being often quoted in publications.

In addition to being extensively published and a sought-after presenter and quoted expert, Ms. Rose holds an MBA with minors in healthcare and entrepreneurship from Vanderbilt University, and a law degree from Stetson University College of Law, where she graduated with various honors, including the National Scribes Award. Ms. Rose also attained a Certificate in Negotiation and Leadership from Harvard University.

Ms. Rose is licensed in Texas and is a Fellow of the Federal Bar Association. Currently, she serves as a Director on the FBA’s National Board, is a Member of and the Immediate Past Chair of the Federal Bar Association’s Government Relations Committee, an Advisory Board member of the Federal Bar Association’s Qui Tam Section, the co-editor of the American Health Lawyers Association’s Enterprise Risk Management Handbook for Healthcare Entities (2nd Edition), as well as a co-author of the ABA’s books The ABCs of ACOs and What Are International HIPAA Considerations? She is extensively published and presents on a variety of matters related to her practice.

She has been named consecutively to the Texas Bar College, the National Women Trial Lawyers Association’s Top 25, Houstonia Magazine’s Top Lawyers (healthcare), the National Trial Lawyers Association’s Top 100 and The Nation’s Top One Percent. Ms. Rose was awarded 1st Healthcare Compliance’s 2019 and 2022 Top Presenter Award. In 2023, she was selected for SuperLawyers (healthcare).

Dr. Jeffrey Robinson is the president and founder of Cleareview Inc. He is also an associate professor of radiology at the University of Washington in Seattle, where he practices Emergency Radiology at Harborview Medical center, the only level 1 trauma center in the northwest United States. He earned his medical degree from the University of Minnesota and did his radiolog residency and interventional radiology fellowship at UCLA as well as an emergency radiology fellowship at the University of Washington. He also holds an MBA from the University of Massachusetts, Amherst. He is certified by the American Board of Radiology and is a member of the Radiological Society of North America, the Association of University Radiologists, the American Society of Emergency Radiology, the Washington State Radiological Society and a fellow of the American College of Radiology.

He is the author of over 50 peer-reviewed scientific publications and two book chapters, including one on expert witness blinding in medical malpractice. He has won awards for teaching, editing and conference organization. He has lectured at both medical and legal conferences and was the co-editor of the 2022 special issue of the Journal of the American College of Radiology on medical-legal issues.

Dr. Robinson has been engaged as an expert witness on numerous occasions for over 25 years, and has appeared for both defense and plaintiff bars. In 2012, he created Cleareview, which provides a level playing field for expert review in radiology malpractice litigation by blinding the expert to the contentious nature of the exam at issue. Cleareview has been engaged in over 200 claims throughout the United States.
