Program Summary

There is no single test to determine a joint employment relationship. Unfortunately, different laws have different tests. If a state or federal law deems two companies to be joint employers, a joint employer could be held liable for the other company’s legal liabilities (e.g., OSHA, wage and hour, discrimination and harassment, FMLA, National Labor Relations Act).

Jeff Shoskin and Anne Duprey, partners with Frost Brown Todd LLP, will help you understand how to analyze risks of joint employment and assess realistic measures to take to minimize and/or avoid joint employment liability.

This course is co-sponsored with myLawCLE.

Key topics to be discussed:

  • The two types of joint employment: vertical and horizontal
  • The various federal law tests (current and proposed) for determining joint employer status
  • Legal and contractual options to minimize and/or avoid joint employer liability

Date / Time: July 26, 2023
