Attorneys who represent either employers or the owners or managers of commercial or residential properties need to know the "nuts and bolts" of getting and enforcing two kinds of restraining orders. The first is the "workplace violence" restraining order, which a California court will issue as a TRO in one day upon a written showing that an owner, employee, or contract guard has been subjected to violence, threat of violence, stalking or harassment in the workplace by the respondent. The second is available on an ex parte basis in a civil action for trespass or nuisance behavior. Commercial and retail owners and managers need these orders to protect their customers and employees from violence, and to cause nonviolent but very disorderly persons to stay away from their properties and businesses. The presenter has obtained these orders on hundreds of occasions - most respondents voluntarily comply with them because they shun the police contact disobedience triggers. The few who disobey are subject to arrest and prosecution. The biggest surprise is that the police everywhere still enforce these orders even though California peace officers do not arrest for trespass under the state trespass law.
