This presentation will discuss the recent legal decisions, including those as recent as July 2023, addressing whether freight broker tort claims can proceed forward or if they are preempted under the Federal Aviation Administration Authorization Act (“FAAAA”), 40 U.S.C. s. 1450(c)(1). This will also discuss what steps freight brokers can take to prevent liability claims, especially with claims of negligent hiring against freight brokers. This presentation will discuss the law in different states and Circuit Courts and what may be expected moving forward.

Stephanie Chesney is a partner in MG+M’s Boston Office. She is licensed to practice law in Massachusetts, Maine, and New Hampshire. She has significant experience defending a wide variety of civil cases from pre-suit through trial. Justin Reinhardt is a partner in MG+M’s O’Fallon and New York offices. He is licensed to practice law in Missouri, Illinois, New York and New Jersey.
