Program Summary

This presentation will discuss the recent legal decisions, including those as recent as July 2023, addressing whether freight broker tort claims can proceed forward or if they are preempted under the Federal Aviation Administration Authorization Act (“FAAAA”), 40 U.S.C. s. 1450(c)(1). This will also discuss what steps freight brokers can take to prevent liability claims, especially with claims of negligent hiring against freight brokers. This presentation will discuss the law in different states and Circuit Courts and what may be expected moving forward.
