Program Summary

This presentation will discuss the recent legal decisions, including those as recent as July 2023, addressing whether freight broker tort claims can proceed forward or if they are preempted under the Federal Aviation Administration Authorization Act (“FAAAA”), 40 U.S.C. s. 1450(c)(1). This will also discuss what steps freight brokers can take to prevent liability claims, especially with claims of negligent hiring against freight brokers. This presentation will discuss the law in different states and Circuit Courts and what may be expected moving forward.

Stephanie Chesney is a partner in MG+M’s Boston Office. She is licensed to practice law in Massachusetts, Maine, and New Hampshire. She has significant experience defending a wide variety of civil cases from pre-suit through trial. Her experience includes representing clients in a variety of business and commercial litigation matters, including employment matters, general liability, transportation, products liability, construction, and premises liability. She has extensive courtroom experience defending claims in the state and federal courts of Massachusetts and Maine. Stephanie has additional experience providing risk transfer and tender advice to clients, as well as advising regarding risk mitigation strategies.
