Program Summary

This presentation covers California’s new “Snitch” rule, formally CRPC 8.3 entitled “Reporting Professional Misconduct,” which, for the first time, requires California attorneys to report their colleagues for certain “criminal” acts or other misconduct. While much has been made of the possible abuse and over-reporting that will follow the implementation of the rule, the language of the rule itself and carveouts therein make such abuse unlikely. Further, substantially similar rules have long existed in other jurisdictions, and we will look to those jurisdictions to help predict what, if any, impact CRPC 8.3 may have on California.

Carl Mueller is a litigation attorney with a focus on attorney client disputes, including legal malpractice claims, breach of fiduciary duty cases, and disputes over legal fees. In addition, Carl has extensive experience in business litigation, including corporate governance and partnership disputes, and in commercial real-estate disputes.

Carl represents clients in state and federal courts, across multiple industries, against opponents that cover the spectrum from solo practitioners to AmLaw100 firms. He is a licensed attorney in both California and Oregon.

Within the community, Carl is an active member of the South Bay Bar Association Board of Directors and is currently the chair of its Civil Section. Carl is the immediate past President of the Marquette University Alumni Association Los Angeles chapter.

Carl graduated from the University of Southern California Gould School of Law, and received his Bachelor’s from Marquette University in Milwaukee, Wisconsin.
