Program Summary

Oftentimes insurers will issue a reservation of rights letter after an insured provides notice of a claim. For many insureds, these letters about potentially uncovered claims are confusing and create more questions than answers. In this course, the speakers will discuss the anatomy of a reservation of rights letter, highlighting common conflicts of interests that can arise between the insurer, the insured and defense counsel. The session will go into the tripartite relationship between the insured, defense counsel and the insurer and how to navigate these legal landmines should such conflicts arise so that insureds can maintain a zealous defense in any underlying dispute while maximizing coverage.

This course is co-sponsored with myLawCLE.

Key topics to be discussed:

  • What is a reservation of rights?
  • What are the potential conflicts of interest?
  • What are the insured’s rights?
  • Ethical considerations for defense counsel
  • Common interest and confidentiality
  • Defense costs and billing
