Program Summary

Session I - Cell and Wireless Tower Law: A regulatory and transactional primer - Brittany Weidner and Bennett Givens

This webinar will explore the latest issues and trends in wireless installations and offer attendees a comprehensive overview of the current legal landscape, including FCC regulations, recent FCC orders, associated litigation, and how such regulations and decisions (1) impact the authority of local governments in regulating these facilities and (2) alter options for property owners with a cell site portfolio.

The constantly evolving regulatory landscape of wireless installations places a strain on local governments with respect to its (1) regulatory review and approval of various wireless facilities and (2) real estate transactions for deployment of wireless facilities on government property. For counsel representing local governments, wireless providers, or property owners with a cell site portfolio, challenges that arise in wireless site leases/licenses include rates, revenue distribution, environmental and zoning issues. Regulatory burdens are also changing with the enactment of FCC shot clocks and collocation fast tracks pursuant to the FCC’s 6409(a) rules and numerous state-level small cell laws.

Brittany Weidner is an associate at Best Best & Krieger LLP, where her practice focuses on telecommunications. She works closely with local governments and public agencies advising on regulatory and transactional matters involving broadband and fiber networks, cable and telecom franchising, leases and licenses, and wireless communication facilities.

Prior to joining BBK, Brittany was an associate at Austin Legal Group, APC, where her practice primarily focused on California commercial cannabis law and land use entitlement matters. She advised and represented private cannabis entities on a broad range of regulatory compliance matters and obtained complex cannabis land use approvals through traditional land use application processes and highly-competitive, merit-based licensing application processes.

Brittany is a San Diego native who enjoys live music, hiking, and spending time with her husband, family, and friends under the California sunshine.

Bennett A. Givens is an associate at Best Best & Krieger LLP who focuses on telecommunications, land use and real estate. He regularly assists clients in California and across the country with a wide range of regulatory and transactional matters involving broadband and fiber networks, cable and telecom franchising, leases and licenses, wireless communications and public-private partnerships.

Bennett primarily represents public agencies, cooperatives, nonprofits and small competitive providers on a wide range of issues related to telecommunications infrastructure.

While earning his law degree at Loyola Law School, Los Angeles, Bennett served as chief research editor for the Entertainment Law Review.
