Program Summary

Every Long-Term Care Problem Has Two Sides: The Family Paying for Care and the Provider Waiting to Be Paid

Demand for long-term care continues to grow, and so do the legal questions that come with it. Medicaid eligibility, asset preservation, healthcare coverage, and financial pressure now land on individuals, families, and care providers at once. Elder law planning and healthcare regulatory issues no longer sit in separate files. They meet in the same long-term care decision.

The stakes show up early. Transfer assets without a plan, and the client may face consequences when eligibility is tested. Wait for a crisis, and the care options narrow before planning starts. On the provider side, the pressure is just as direct. Miss a reimbursement requirement, and a coverage or payment dispute follows. Face an audit, an investigation, or an alleged overpayment, and provider operations and the availability of services are on the line.

You walk out with a working approach to Medicaid planning: evaluating eligibility, weighing the consequences of asset transfers, and coordinating estate and long-term care plans before a crisis arises. You also gain a provider-side view of Medicare and Medicaid reimbursement, audits, investigations, and alleged overpayments. Both sides of the program turn on judgment calls that a checklist alone cannot make for you.

Key topics to be discussed:

  • Medicaid Planning Strategies
How to evaluate Medicaid planning options and eligibility requirements with a client before a long-term care crisis forces the decision.
  • Asset Transfer Consequences
How asset preservation moves and transfers can carry consequences, and how to identify those legal risks before a client acts.
  • Coordinated Estate Planning
How to coordinate estate planning with long-term care planning so clients can evaluate care options and anticipate future expenses.
  • Reimbursement and Coverage Disputes
How Medicare and Medicaid reimbursement frameworks drive the coverage and payment disputes that affect long-term care providers and the people they serve.
  • Audits and Overpayments
How to respond when audits, investigations, alleged overpayments, and regulatory compliance concerns put a healthcare provider client at risk.
  • Enforcement and Access to Care
How reimbursement and enforcement issues affect provider operations and the availability of services, and how to recognize those challenges early.
