Generative Artificial Intelligence (AI) is one of the hottest topics today not only in legal circles but for society at large. Its rapid advancement in recent years has drawn significant attention by the media, attorneys, legislators and regulators, and the communities that are impacted by its advancements, particularly content creators. Apart from the many moral, ethical, and regulatory considerations, major topics of debate among lawyers and creatives revolve around how the current Copyright Act applies (or doesn’t apply) to this complex and exciting technology. In this CLE webinar, we will discuss the background and development of generative AI and how it works at a basic level, and then will dive into the nuanced and controversial legal topics of copyright ownership and authorship of AI-generated content, what happens when AI creates infringing output, and the heated debate surrounding the applicability of the fair use doctrine to AI companies’ scraping of creators’ content from the Internet for use as training data.
