Program Summary

The Expert Fight Is Won Before Cross Ever Starts

The Federal Rules of Evidence just went through their most significant overhaul in recent memory. The December 2023 and December 2024 amendments touch everything from impeachment sequencing to how exhibits reach the jury. Amended Rule 702 sits at the center of expert practice.

Expert testimony can shape the outcome of a case. Put up an expert without command of amended Rule 702 and admissibility becomes the fight. Take a deposition without a cross-examination plan and the transcript gives you nothing at trial. Seek exclusion without strategic evaluation and the motion becomes its own gamble. Economists, life-care planners, and treating physicians each demand a different approach.

Attendees leave with detailed tips and techniques for cross-examining expert witnesses and a working command of expert admissibility requirements. The program delivers deposition strategies that set up cross-examination and a framework for evaluating motions to exclude. It covers impeachment methods and approaches for challenging opinions, methodology, and conclusions while maintaining credibility. It is built for practitioners who try cases in federal court or advise clients on federal litigation strategy.

Key topics to be discussed:

  • Rule 702 Amendments
How the amended rule changes what expert admissibility now requires.
  • Expert Depositions
Areas of focus and techniques for depositions that set up cross-examination.
  • Exclusion Strategy
Evaluating whether to seek exclusion or limitation of an expert's testimony.
  • Motion Advocacy
Practical tips and advocacy strategies for preparing and arguing successful exclusion motions.
  • Cross-Examination Techniques
Impeachment methods and approaches for challenging opinions, methodology, and conclusions.
  • Courtroom Credibility
Challenging experts while maintaining credibility with the court and jury.
