Program Summary

As the demand for H-1B workers across the US economy remains high and as changes being imposed by the Administration make qualifying for an H-1B far less certain, employers, foreign nationals, and counsel are increasingly forced to be more creative and proactive in complying with H-1B requirements while also having to explore alternative strategies. This program examines the current H-1B landscape and explores practical, legally sound immigration alternatives that can be deployed to maintain access to global talent. Panelists will focus on strategic planning, risk mitigation, and creative use of existing visa categories in an environment of heightened scrutiny and limited options.

  • Structural constraints of the H-1B system, including lottery mechanics, travel bans, cap limitations, adjudication trends, and compliance risks
  • Employment-based nonimmigrant alternatives to the H-1B, such as O-1, TN, J-1, E-3, H-1B cap-exempt pathways, and L-1 strategies
  • Global mobility and outbound solutions, including remote work models, short-term assignments, and foreign affiliate options
  • Long-term planning beyond the H-1B, including permanent residence strategies and sequencing approaches to reduce reliance on capped visas

Ari Sauer | Siskind Susser PC

Ari J. Sauer is a Partner at Siskind Susser, PC, practicing exclusively U.S. immigration and nationality law. Ari represents both corporate clients and individuals in all areas of U.S. immigration law. He assists businesses in obtaining visas, permanent residence, and citizenship for their employees and their families. He also assists U.S. citizens and permanent residents in sponsoring their family members for immigrant and nonimmigrant visas, as well as helping individuals become U.S. citizens.

Ari is a former elected Director of the Board of Governors of the American Immigration Lawyers Association (AILA). He has previously served as Chapter Chair of the AILA Mid-South Chapter, which includes the states of Tennessee, Mississippi, Arkansas, Kentucky, and Louisiana.

Ari co-authors the publication AILA’s Immigration Law Practice and Procedure Manual: A “Cookbook” of Essential Practice Materials. This 4,300+ page how-to resource for immigration lawyers is one of AILA’s core publications. The publication is now in its fourth edition (2025). He regularly speaks about immigration law for AILA and other organizations.

Ari received his law degree from Yeshiva University’s Benjamin N. Cardozo School of Law in New York, NY.

Elissa Taub is a partner with Siskind Susser PC, where she leads the firm’s Healthcare Immigration Group. She has extensive experience with a wide variety of immigration processes for physicians, nurses, and other healthcare professionals, including J-1 waivers, H-1Bs, O-1s, EB-1 extraordinary ability petitions, National Interest Waivers and labor certification based green cards.
