The $1 Million Safety Net Is Gone

SB 371 and AB 1340 rewrite California's TNC insurance framework effective January 1, 2026. UM/UIM coverage falls from $1 million to $60,000 per person, a 94% reduction. A new $200,000 conditional excess layer appears in Period 1, and every period's rules shift.

The stakes arrive with the first file. Misclassify the operational period and coverage disappears. Miss notice or exhaustion requirements and the UM/UIM claim dies. Let the five-year arbitration deadline pass and the bad-faith lever is forfeited. Anti-stacking rules and pro rata allocation cap what layering can recover.

His practice is devoted to personal injury litigation and trial work with a particular emphasis on insurance coverage, and he is a recognized authority on uninsured and underinsured motorist law in California. Other practicing attorneys regularly consult him on uninsured and underinsured motorist arbitrations.

Mr. Goldberg earned his B.A. in Political Science from the University of California, Los Angeles, and received his J.D. from Loyola Law School Los Angeles in 1984, gaining his California license that same year. He is admitted to all California courts, all federal district courts, the Ninth Circuit Court of Appeals, and the United States Supreme Court Bar.

He is a frequent lecturer on legal topics, and his article “Mastering Uninsured and Underinsured Motorist Arbitrations” was published in November 2020 in The Advocate, the CAALA trial lawyers magazine.

With more than 35 years of consistent practice on behalf of injured consumers, Mr. Goldberg has handled numerous trials and hundreds of arbitrations and mediations and has argued matters before the California Court of Appeal and the Ninth Circuit Court of Appeals.
